交際していた男性が住むマンションの玄関ドアを壊したとして、器物損壊罪に問われたタレント小桜セレナ被告（３８）の控訴審判決で東京高裁は３日、懲役１年２月、執行猶予３年とした１審判決を破棄、無罪を言い渡した。

「け破られたドアの穴から被告が入ってきた」という住民の目撃証言の信用性が争われたが、原田国男裁判長は、穴は縦約７２センチ、横約２４センチだったとして「被告は胸囲１０１センチ、胸板２９センチで穴をくぐり抜けられない」と信用性を否定。「犯人とするには合理的疑いが残る」と述べた。
判決によると、小桜被告は２００６年１１月１８日朝、東京都港区西麻布のマンション１階にある男性方を訪れた際、木製玄関ドアの中央部分をけ破ったとして起訴された。被告は先に部屋にいた別の女性ともみ合いになり、その後、男性が帰宅。隣室の住民の通報で警察官が駆けつけ、ドアの破損を確認した。
